Yes, you should. Your design application may be subject to the exceptional provision for loss of novelty in Japan if certain requirements are met, such as that the design is filed within one year from the day the novelty was lost; and that the novelty of the design has been lost because of an action of a person having the right to obtain rights to the design or against the will of the person having the right to obtain rights to the design.
