Q 10. What is the time limit for responding to an office action (Notice of Reasons for Rejection, or Notice of Decision of Refusal)?
As to a Notice of Reasons for Rejection, the time limit for the applicant resident outside Japan to file a response is three months from the mailing date of the office action. The time limit for responding to a Notice of Reasons for Rejection can be extended. Specifically, the time limit can be extended for a maximum of three months; two-month extension on the first request and another one-month extension on the second request. As to a Notice of Decision of Refusal, the time limit for the applicant resident outside Japan to file a response is four months from the mailing date of the office action, which cannot be extended.
